LEGAL Act will bolster employment accountability and reduce illegal labor in Montana


HELENA, Mont. (Jan. 14, 2025)—In response to growing concerns across Montana, Courtenay Sprunger (R-Kalispell) today announced her bill to reduce illegal labor in the state. The Legal Employment and Government Accountability Law (LEGAL Act), anticipated to be introduced in the Montana Legislature this week, aims to enhance compliance with employment verification laws across the state.


By requiring employers to verify the legal eligibility of employees before work begins, the bill addresses workforce accountability and aligns state practices with federal standards.

“The LEGAL Act provides critical tools for ensuring fairness and accountability in Montana’s workforce,” said Representative Courtenay Sprunger-R, Kalispell. “By leveraging verification systems already in place, we can promote lawful employment practices while protecting the integrity of our labor market.”


The LEGAL Act establishes clear guidelines for employers to confirm employment eligibility using federal resources such as the E-Verify system or Form I-9 documentation. Employers utilizing E-Verify in good faith are safeguarded from penalties if errors arise due to the system’s data.


Key provisions include:

  • State Enforcement: The Montana Department of Labor and Industry (DLI) will oversee compliance and conduct investigations when necessary.

  • Inspections: The legal employment audit will be added to the standard inspection process conducted by DLI and will not merit

  • Penalties: Employers found in violation face escalating fines, ranging from $500 for first offenses to $2,500 and license suspensions for repeat violations.

  • Revenue Fund: Penalties collected will be deposited into a special state fund to support education and enforcement efforts.


“Montanans value a fair and honest approach to employment,” said Representative Sprunger. “This legislation ensures bad actors undercutting the market with illegal labor are held accountable.”


The LEGAL Act also provides safeguards for employers to maintain compliance without undue burden. Funds generated through penalties will be reinvested to educate businesses on employment verification requirements.
